Marks Seeks Collaboration with Unions

I sat down with Susan Marks earlier this week to discuss school issues.  When the topic of contract negotiations came up, Marks went immediately to her bookshelf and pulled out the classic book on negotiations. “Getting to Yes” Roger Fischer and William Ury of the Harvard Negotiation Project.  “I support interest-based bargaining,” she said.  “I’m anxious to utilize this process here—it’s all about relationship building.”

Recently, the Norwalk Federation of Education Personnel, the union of the district’s support staff and the Norwalk Board of Education could not agree on terms of a new contract and went into arbitration, a process by which independent outside parties decide on the terms of the contract.

Marks explains that interest-based bargaining is about aligning interests and building trust. “The school district and the union have many similar interests,” says Marks.  “For example, we both want children to do well in school.  We both want teachers to be happy.  This is our outcome.”

“Getting to Yes”, a bestseller since it was published in 1981, focuses on four basic principals:  separating the people from the problems, focusing on interests not positions, generating options for mutual gain, insisting on using objective criteria.

This type of bargaining is collaborative and requires a team approach says Marks.  “Two parties do not sit across the table in an adversarial way.  They sit next to each other.” Marks calls the method a “mind shift” from the traditional adversarial approach.

Marks says that she is “passionate” about this method, which was used in Montgomery County, the Maryland school district where Marks worked for many years.

“It took a lot of training and time, but through blood, sweat and tears, we got to a point where now [in Maryland] the teachers' union and the district write the contract together,” says Marks. “There is no mediation needed.”

In the midst of talking about negotiations, Marks got up and pulled another book from her shelf, “Choosing Civility: The Twenty-five Rules of Considerate Conduct", by P.M. Forni of the Johns Hopkins Civility Project.  “I want to create a culture of civility here, where people are nice to each other.”

“You can be honest, without being disrespectful,” says Marks.  “The three things people can always expect from me are-- I am polite, I speak my mind and I tell the truth,” says Marks.

  1. Support staff are the worst paid BOE employees that often don't even have health insurance. Anytime the BOE is looking to cut money, we are always looked at. All that we are asking is for a fair contract.The BOE are the contentious ones.

  2. "Getting to Yes" is a book from THIRTY years ago that typifies where we are in Norwalk today. Interest-based bargaining?? How about making a living in a world so vastly changed?? Marks is very good at pulling an old rabbit out of her hat, but that rabbit died a long time ago. If a dog-eared book off the shelf is the best she can offer this district, good luck. Makes you wonder what Jack Chiaramonte has in his library!! Mind shift?? Who played shortstop for the 1981 Yankees?? That's a mind shift! Sorry, but one would be better off consulting the old Magic 8 Ball. GO NFEP--Kick A-- and take names!

    'This is how we did it in ------(fill in the blank with the last district the superintendent came from)

    That doesn't work in Norwalk. We are NOT Maryland. See us for ourselves!

  4. You don't have to be from Norwalk to understand respect, kindness, and sincerity and true leadership. It is amazing how we already have naysayers--who just go after anyone like raw meat on a hot tar road.
    Give the superintendent an opportunity to lead this district. There has not been true leadership in over 15+ years...
    the district didn't get into this condition over night.

  5. Listen, I'm no naysayer. I'm not looking to feast on raw meat. I'm just a parent of 3 kids who follows what the Board of Education does and doesn't do to help the schools.

    It's tough for many of us to think that the new superintendent is really any different.

    She was silent when a disgraceful track record was rewarded by giving Rutolo a raise and more paid time off. I keep hearing about ethics violations of the new grant writer, who the new superintendent defended (my friend told me the report is on the Wethersfield Board of Ed website).

    From what I see, one month and no changes- but more of the same.

  6. Maybe Jack can tell me how he'd feel if a customer demanded a "give-back" after she bought a piece of jewelry from him?
    After all, isn't that he wanted from every employee--- make a deal but then look for something extra?
    The only good thing to come out of this may be the people in Rowayton, when they realize what Jody Bishop Pullan is costing us in arbitration fees will finally dump her.

  8. Norwalk needed a younger, more dynamic superintendent. This is not age discrimination at all, but a reality-check of where we are in the world today. Susan is going to find out very quickly that she is not in Maryland anymore,and neither are the kids and adults she is now leading. When the BOE took the bait from the search moguls, this is what we have. She has had a great career, but Norwalk should not be the exclamation point. Sometimes it is just time to retire. Oh, wait, this is Norwalk, where retirement on the job is King. Hope I'm wrong, but experience tells me otherwise.

  11. Some of the best business books for profits and non-profits were written by Peter Drucker in the 60s and 70s - and are still being used as textbooks today. I'm happy that Dr. Marks is using Getting to Yes rather than Leadership Secrets of Attila the Hun!

  14. Things are not going to change over night - give her (Dr. Marks) some time. On another not and change of this topic - Moina, can you update us on whatever happened to the PTOC group? did they finally dissolve? I'm a tired parent of two kids - and as hectic as it was for me, I decided not to run at my local schools PTA. But I do remember the issues of PTOC - I was there are their last meeting. Do you know what happened?

  16. Doubtful that two people in the same line of work could have the same name. How coincidental that Stamford may again come into play with administrative hires, if this is indeed her. Things that make you go hmmmmmm....

  17. 1:24 p.m. - Just so you know, the Board already did an "I'm Okay, You're Okay" workshop back in the start of the new year. They had a facilitator come in for a "retreat", which was also an open meeting. I believe minutes were also taken at the "retreat", which almost belies the entire point of the whole exercise. From what I understand, it was supposed to be a chance for them to talk about issues and how they felt, but it's hard to do that with former Board members sitting there and also knowing that someone is taking notes for minutes.

    So, yeah, they did it - all but singing Kumbaya.

  18. I just read the findings on Dr. Negroni. Aside from the fact that there are many sections blacked out, it is absolutely NOT true that she was cleared. I suggest that everyone read about the allegations of misuse of funds under her purview and of allegations by the union that she forged teachers' names. Also, be sure to read the last paragraph. Is it a surprise that she left her position to come to Norwalk? I'm thinking that she was let go. Anyone have information on that?

    per diem payments --costing district mucho bucks

  21. The acting financial officer has also been paid over $330,000 during the last 2 years and he doesn't even know where Room A300(Board Room)is and he works on the same floor. To the new "Parents Not Politians" Board Members - thank you very much for allowing this situation to continue. I can't wait until your term is up for re-election! You are definitely out! Also, you should be checking into Fay R. - you voted for her substantial increase and she needs to be fired! She is so connected to Stamford and still getting all of her friends (Dan C., Tally N., and more) into our school system. She needs to evaluated soon! Thank you to the previous Interim Supt. for getting and keeping all of his friends into NPS. Also,thank you BOE Members for allowing this situation to continue!

  22. Keep vigilant, parents. It is important to watch the new appointees made by this BOE. Stay with the new grants person, the new Director of Elementary Education and the new Superintendent. Keep these three under a microscope. They need to know that they are being held accountable for change.
